Patent or utility model?

A utility model may be of interest due to lower costs as even program logic and methods of treatment for animals can be protected and there is provision for a 6-month period of grace with respect to one's own publications.
A utility model differs for instance from a patent in the following respects:

  • shorter period of validity (10 years versus 20 years)
  • lower costs
  • period of grace (for publications attributable to the inventor published not more than six months prior to the application for the utility model)
  • also permissible for protection of program logic and methods of treatment for animals' bodies
  • no preferential treatment under commercial or taxation law
